Schubert jury deadlocks, later resumes deliberations
EVERETT — The jury in David Schubert's murder trial indicated yesterday that it was deadlocked, and then reconsidered and continued through a fifth day of deliberations.
Jurors yesterday afternoon sent Snohomish County Superior Court Judge Ronald Castleberry two questions concerning whether a defendant could be found guilty of murder if the act was not deliberate. The judge indicated that in order to convict of either first- or second-degree murder, the jury must find that Schubert intended to cause the death of Juliana Schubert.
Shortly after, jurors sent Castleberry a note telling him they couldn't come to a unanimous conclusion about either first- or second-degree murder charges against Schubert in the presumed death of his wife, and asking what they should do.
Castleberry instructed jurors to discuss whether there was a reasonable probability that they would reach a unanimous verdict within a "reasonable period of time."
Twenty minutes later, they told the judge they likely could, but asked if they could go home for the remainder of the day. Castleberry denied this request, ordering them to deliberate until 4:30 p.m. They are to reconvene today.
Schubert, 62, is accused of killing Juliana Schubert 13 years ago, though her body has never been found. His first murder trial ended with a hung jury last year.
Seattle-Portland train line reopens after derailment
VADER, Lewis County — The Burlington Northern Santa Fe main line between Seattle and Portland, closed Sunday by a freight-train derailment, was reopened before noon yesterday.
One track on the main line was opened at 6:30 a.m. and the other at 10:30 a.m., railroad spokesman Gus Melonas said.
Two locomotives and 22 cars were derailed when a maintenance train rear-ended a freight train about 1:30 a.m. Sunday. The locomotives were removed early yesterday.
Three gondola cars hauling rock were put back on the tracks, as well as one of two derailed flatcars hauling containers. That left 18 cars at the site. They were pushed to the side for the time being, and some may be scrapped.
The cause of the accident has not been determined.
